 State Regulations 

 Compare

(1)
 A recommendation by any DMH/MR Division
 for decertification may be appealed to the Commissioner within fifteen (15)
 working days of the entity receiving the report/recommendation. The appeal by
 the entity must specify the precise reason(s) for the appeal and provide
 documentation to support modification of the site visit findings/recommendation
 for decertification.

(2)
 Any final
 decision to order decertification of a program will be made by the DMH/MR
 Commissioner after the affected provider is afforded the opportunity for an
 administrative hearing on the matter. Such hearings will be conducted in
 accordance with the Alabama Administrative Procedures Act.
