This section of Alabama's Department of Mental Health rules allows providers not otherwise covered under chapter 580-1-2 to contract directly with DMH/MR for a range of programs including inpatient, outpatient/therapy, partial hospitalization, emergency care, residential/respite care, rehabilitation/habilitation, and prevention services related to mental illness, alcoholism, drug addiction, epilepsy, or intellectual disability. It also grants the Commissioner discretion to waive certain planning, subcontracting, or recognition requirements for 310 Boards when doing so serves the public interest. Facility operators seeking to contract outside the standard certification pathway must do so under these exception provisions.

 State Regulations 

 Compare

(1)
 Providers, not
 otherwise covered by 580-1-2, may contract directly with DMH/MR for one or more
 of the following programs or services:
(a)

 Inpatient

(b)
 Outpatient/Therapy
 Services

(c)
 Partial
 Hospitalization

(d)
 Emergency
 Care

(e)
 Community Education and
 Consultation

(f)

 Diagnosis

(g)
 Evaluation

(h)
 Rehabilitation/Habilitation

(i)
 PreCare

(j)
 Residential Care/Respite Care

(k)
 Aftercare and

(l)
 The prevention of all forms of mental or
 emotional illness, including, but not limited to, alcoholism, drug addiction,
 epilepsy, or mental retardation.

(2)
 The Commissioner at his/her discretion
 may grant an exception to 310 Boards for the requirements of planning, studies,
 and/or programs, or for provisions relating to subcontracting, or for the
 recognition of a 310 Board when it is determined that the exception is in the
 best interest of the public and/or of the populations to be served.
