This Louisiana statute restricts the Department of Health from licensing opioid treatment programs (OTPs) under the behavioral health services provider license unless the department determines a geographic need exists. The department is required to promulgate rules establishing criteria and processes for assessing need and selecting which OTP to license once need is determined. Operators seeking an OTP license must demonstrate geographic necessity before licensure will be granted.
