This section establishes a waiver process for psychiatric outpatient clinic standards under 55 Pa. Code Chapter 5200. Operators of specialty psychiatric outpatient clinics—such as those in rural areas or serving specialized populations—may apply for a waiver when compliance with chapter standards would severely limit service development, provided the need and compliance efforts are thoroughly documented. Waivers are granted only in exceptional circumstances and require Department approval.

Code § 5200.48 - Waiver of standards State Regulations Compare In instances where the development of specialty psychiatric outpatient clinic services is severely limited by these standards, such as rural clinics or specialty clinics, a waiver may be granted. Waivers may be applied only in areas where the need for these services and the attempts to meet the standards are adequately documented.
