This section establishes provider eligibility and licensing requirements for Intensive Behavioral Health Services (IBHS) agencies in Pennsylvania. All IBHS agencies must obtain a Department license before beginning operations, with transition timelines provided for agencies already holding outpatient psychiatric clinic, psychiatric partial hospitalization, family-based mental health, or ABA services approvals as of October 2019. All IBHS agencies must comply with the chapter as of January 17, 2020, and must meet the general licensure requirements in Chapter 20.

Code § 5240.3 - Provider eligibility State Regulations Compare (a) Except for IBHS agencies described in subsections (c)-(e), an IBHS agency shall obtain a license from the Department prior to beginning operations. (b) Regardless of when a license is obtained, an IBHS agency shall comply with this chapter as of January 17, 2020. (c) An IBHS agency that holds an outpatient psychiatric clinic, a psychiatric partial hospitalization program or a family based mental health license issued by the Department as of October 19, 2019, shall obtain a license under this chapter when the license expires. (d) An IBHS agency that is approved to provide ABA services shall obtain a license under this chapter within 180 days of October 19, 2019. (e) An unlicensed IBHS agency that is currently approved to provide behavioral health rehabilitation services shall obtain a license under this chapter within 1 year of October 19, 2019. (f) An IBHS agency shall meet the requirements in Chapter 20 (relating to licensure or approval of facilities and agencies). Notes 55 Pa.
