This section establishes the process by which the DC Department of Behavioral Health may grant, renew, or revoke exemptions from certification standards for certified behavioral health providers. A provider may request an exemption in writing upon good cause (e.g., conflict with a third-party contract), provided the exemption does not jeopardize client health, safety, or rights. Exemptions are time-limited to the provider's certification period and may be revoked at any time if client or public welfare is at risk.
View official source6304 CERTIFICATION: EXEMPTIONS FROM STANDARDS Upon good cause shown, including but not limited to a conflict between a certification standard and a provider’s third-party contract or agreement, the Department may exempt a provider from a certification standard if the exemption does not jeopardize the health and safety of clients, violates a client’s rights, or otherwise conflict with the purpose and intent of these rules. If the Department approves an exemption, such exemption shall end on the expiration date of the provider certification, or at an earlier date if specified by the Department, unless the provider requests renewal of the exemption prior to expiration of its certificate or the earlier date set by the Department. The Department may at any time revoke an exemption if it that it determines that the exemption may jeopardize the health, safety, or welfare of the clients/consumers served, staff, volunteers, and/or the general public. All requests for an exemption from certification standards must be submitted in writing to the Department.
