If a private psychiatric hospital is not nationally
 accredited or certified under §
 
5300.1
 (relating to
 accreditation), the Department will apply the JCAH standards which are in
 effect on the date the application or re-application for a license is made, as
 well as applicable sections of Chapter 5100 (relating to mental health
 procedures).
