Providers licensed under this chapter must permit employees and legal counsel of Pennsylvania Protection and Advocacy (PPA) to access the facility, its records, residents, and staff in accordance with the federal Protection and Advocacy for Mentally Ill Individuals Amendments Act of 1988. This access requirement applies to all facilities governed by Chapter 5320, which covers mental health residential and related behavioral health programs licensed by OMHSAS. Operators must not obstruct or limit PPA access rights.
