This section establishes the Department's policy on granting waivers to specific requirements within Chapter 5320, which governs community mental health and support programs licensed by OMHSAS. A waiver may be granted at the Department's discretion for good cause, but only when the health, safety, and welfare of residents and quality of services are not compromised. The Department retains the right to revoke any waiver if its conditions are not maintained.

Code § 5320.101 - Waiver of standards State Regulations Compare It is the policy of the Department that the licensees comply with applicable Departmental regulations to assure quality of care. The Department may, within its discretion and for good reason, grant waivers to specific requirements contained in this chapter. A waiver will be granted only when the health, safety and welfare of the residents and the quality of services provided to residents are not affected.
