This section grants authorized Department representatives the right to enter, visit, and inspect any facility holding or applying for a certificate of compliance under Chapter 711, with full access to facility and client records and the ability to interview clients. It is an enforcement/inspection provision within a licensing chapter administered jointly by OMHSAS and DDAP, covering both mental health and substance use disorder facilities. Operators must accommodate unannounced or scheduled inspections and provide complete access to documentation and clients upon request.

Code § 711.15 - Right to enter and inspect State Regulations Compare (a) For the purpose of determining continuing conformity of the holder of the certificate of compliance to this title, an authorized representative of the Department has a right to enter, visit and inspect a facility licensed/approved or applying for a certificate of compliance under this chapter. (b) The authorized Department representative shall have full and free access to the records of the facility and its clients.
