This regulation governs the process for establishing a new community mental health center (CMHC) in Kansas or altering an existing CMHC's service area. A new center may not be approved if the proposed service area is already served by a licensed CMHC, unless the relevant county commissioners formally withdraw designation of the existing center and request approval of the new one. Any proposal to serve an unserved area must be accompanied by a full license application per K.A.R. 30-60-6.

Establishment of a new community mental health center; altered service area. (a) Pursuant to K.S.A. 19-4001 and amendments thereto, the establishment of a new community mental health center shall not be approved by the secretary if the proposed center's service area is already being served by one or more existing licensed centers, unless the respective board or boards of county commissioners notify the secretary of the following: (1) The intent of the board or boards to withdraw their designation of the existing licensed center serving that area as their community mental health center; and (2) the request of the board or boards that the secretary approve the establishment of a new community mental health center, as requested in accordance with K.A.R. 30-60-11 . (b) No licensed center may alter its existing service area to include an area already being served by one or more other licensed centers, except in compliance with subsection (a) and K.A.R. 30-60-11 . (c) Each proposal to establish a new community mental health center to serve an area not then being served by a licensed center shall be accompanied by an application for a license as a community mental health center as required by K.A.R. 30-60-6 .
