This regulation authorizes the issuance of a provisional license to an agency that meets most but not all licensing requirements, provided the governing board demonstrates that any deficiency is temporary and that corrective efforts are underway. It applies within the chapter governing licensing of psychiatric hospitals and funding of community mental health centers and facilities for persons with intellectual/developmental disabilities and handicapped persons. Operators must present evidence of both the temporary nature of the deficiency and active remediation efforts to qualify for provisional status.
