440 IAC 12 ASSERTIVE COMMUNITY TREATMENT TEAMS

Jurisdiction: IN Agency: Indiana Division of Mental Health and Addiction (FSSA)
CMHC (50%) MH_IOP (40%) OUTPATIENT (60%) SUD_IOP (40%)
Plain-English summary

This Indiana regulation establishes rules for court-based mental health referral programs authorized under IC 33-23-18, which connect 'qualified adults' (individuals identified by courts) to mental health and addiction forensic treatment services. Program councils must submit guidelines to the Division of Mental Health and Addiction for authorization before operating, and those guidelines must specify assessors, timelines, treatment providers, and available services including mental health, peer support, and co-occurring treatment. Treatment providers participating in these programs must hold appropriate professional licenses and be certified by the Division as mental health and addiction forensic treatment services providers. The Division retains oversight authority, including the ability to investigate complaints and impose sanctions for non-compliance.
