This regulation establishes governing body requirements for substance abuse treatment and/or prevention providers certified by the Alabama Department of Mental Health. Providers must be incorporated entities and submit documentation of their legal authority (articles of incorporation/charter and bylaws) to DMH. The Board of Directors bears overall responsibility for operations, and meeting minutes must be available to the Substance Abuse Certification Review Team upon request. Providers contracting with the State of Alabama must also keep current financial audits on file with the DMH Substance Abuse Division.

580-9-40-.01 Organization
(1) The provider must be a public or private corporation, it must provide written documentation to DMH/MR of its source of authority through its articles of incorporation (or charter) and bylaws. (2) The Board of Directors of the corporation, as its governing body, have responsibility and authority for the overall conduct of operations including the treatment and/or prevention programs provided by the organization. (3) A copy of the minutes from schedule Board of Directors meetings must be available to the Substance Abuse Certification Review Team upon request. (4) The latest financial audit shall be on record with the DMH/MR, Substance Abuse Division, if the State of Alabama contracts with an agency or organization to provide treatment or prevention services.
