This regulation requires all certified community behavioral health service providers in Alabama to establish and maintain a Human Rights Committee that advises the community program director on client rights issues. The committee must include a majority of non-employees, with representation from consumers, family members, advocacy organizations, local officials, and citizens at large. Members must sign confidentiality agreements, and the committee must meet at least quarterly, review rights-related policies and grievances, and report activities and recommendations to the program director.

(2) The Human Rights Committee shall be composed of a majority of individuals that are not employed by the program, and shall consist of representatives from each of the following groups: (a) Current and/or former consumers of services; (b) Family members of consumers; (c) Representatives of community support & Advocacy Organizations; (d) Local officials; (e) Citizens at large; (f) Performance Improvement/Quality Enhancement Staff (Ex-Officio). (3) Human Rights Committee members shall be required to sign a statement, prohibiting them from disclosing confidential information to others except in the performance of Human Rights Committee functions and duties. (a) elect officers (Chairperson; Co-Chairperson; Secretary) to carry-out duties in an orderly fashion, with the Chair and Co-Chair not being employed by the program ; (b) develop by-1aws and operational procedures necessary to perform duties and responsibilities; (c) meet at least quarterly; (d) keep minutes of all meetings and maintain related correspondence; (e) report all committee activities and recommendations to the program director. (2) The Human Rights Committee will include, but not be limited to, activities such as: (a) assisting in the review of rights-related policies and procedures; (b) promoting rights-related education and training programs; (c) reviewing rights restrictions; (d) assisting in monitoring activities; (e) advising the program administrator on consumer rights-related grievances; (f) reviewing rights-related issues in behavioral plans.
